General conditions of Sale
These general conditions discipline the methods of sale of the products marketed by Lapini S.r.l. (“products”).
All contracts for the sale of Products by Lapini S.r.l. to third parties (the “Customers”) are governed by these General Conditions, which form an integral and substantial part of each proposal, order and purchase order confirmation of the Products themselves. The conditions of sale applicable to orders are those in force on the date of the order itself. With the electronic transmission of the order form, the customer confirms that he knows and accepts these conditions.
Products: prices and features
Unless otherwise indicated, the prices of the Products published on the site by Lapini S.r.l. are expressed in Euros and include VAT. Shipping costs are excluded.
Shipments outside the European Community (outside the EU) are also net of any customs duties, which will be charged to the recipient and will be requested by the shipper during the delivery phase. The price guaranteed to the buyer is the one published on the online shop at the time the order is sent, and is fixed and definitive.
The technical and functional characteristics relating to the Products, published by Lapini S.r.l. through their informative messages in the descriptive internet pages of the articles, are those communicated by the respective manufacturers. Lapini S.r.l. assumes no responsibility for the truthfulness and completeness of this information. The images of the products are indicative and not binding.
The Products are not provided on trial. The Customer is responsible for the choice of the Products ordered and for the compliance with his needs of the specifications indicated by each brand resold.
Orders – invoicing
Each order of Products sent to Lapini S.r.l. constitutes a contractual proposal from the Customer. The fulfillment of the order by Lapini S.r.l. is equivalent to confirmation and acceptance of the same.
The tax documentation relating to the Products ordered will be issued by Lapini S.r.l. at the time of shipment of the Products to the Customer.
The Customer must indicate the exact data necessary for invoicing and specify the shipping address of the invoice itself.
The sales invoice will be sent together with the goods.
Execution of the order
The order will be executed in the terms specified on the Site.
Once confirmed, the order can be canceled only within 24 hours, after which the customer is obliged to pay. In accordance with the relevant laws, the customer can still return the item within 14 days, following our Return Policy (See point 9).
In case of non-execution of the order by Lapini S.r.l. (if the same is due to unavailability of the Products ordered by the Customer), Lapini S.r.l. will inform the customer as soon as possible of the expected delivery times for the supply of the missing product. If the Customer does not intend to wait for this time, in any case not exceeding 30 working days, Lapini S.r.l. will reimburse any sums already paid for the non-executed supply.
In the event of breakage, stock depletion or unavailability of the ordered Product, Lapini S.r.l. undertakes to inform the customer as soon as possible and to specify a different term for availability. The Customer will confirm his choice by e-mail, that is, wait for the availability of the Product or request a refund.
Acceptance of order
The conclusion of the contract will take place only upon confirmation of the order by Lapini S.r.l ..
The Customer will receive by e-mail indicated during the purchase a notification of receipt showing the order confirmation with all the constituent elements of the contract (products ordered, prices, delivery dates, shipping costs) Lapini S.r.l. reserves the right not to confirm an order for any reason relating in particular to a problem concerning the order received or the supply of Products.
Delivery of the Products
The Products are delivered to the shipping address indicated by the Customer.
Shipments will take place after receiving confirmation of payments: for bank transfer, crediting to our bank account, for payment by credit card / Paypal, with confirmation of the transaction by the circuit.
For our shipments we rely on the service of qualified express couriers such as Bartolini or Couriers specialized in the delivery of furniture and furnishings to guarantee the quality of the service and the integrity of the Products.
Normally deliveries are made within 24/48 hours for Italy and 2/6 days for other destinations only for products available in stock (different delivery times will eventually be indicated in the description of the individual products). Shipping times are indicated in working days. The shipping term of an order containing items with different delivery times is equal to the longer shipping term of the items in order. Any delays in deliveries of less than 30 (thirty) days do not entitle the Customer to refuse the delivery of the Products, nor to claim damages or compensation of any kind.
Lapini S.r.l has the right to carry out, if deemed appropriate, the request for delivery of the Products (also relating to the same order) in several successive stages.
Delivery is considered as performed from the moment the Product is delivered to the Customer. The delivery document issued by the carrier, dated and signed by the Customer upon delivery of the Product, will constitute proof of the transport and release of the goods.
It is important to know that:
On delivery, the Customer must check the content, conformity and status of the Product (s). Therefore, on delivery, Lapini S.r.l. recommends the Customer to check the status of the delivered Products before signing the acknowledgment of receipt, and to ensure in particular:
– that the number of packages delivered corresponds to what is indicated in the transport document attached to the shipment;
– that the packaging is intact, not damaged, wet or otherwise altered, and to check the integrity of the content.
If the Customer finds anomalies, he is required to refuse the delivery of the products or to put his reservations in writing in a detailed and dated document. If the courier’s document is signed without affixing any “reserve”, the Customer will not be able to make any objection regarding the external characteristics of what has been delivered. Any problems relating to the physical integrity, correspondence or completeness of the Products received must be reported within 3 (three) days of delivery.
Collection of products in case of absence of the customer
In case of absence of the recipient during delivery, the carrier will leave a notice of passage to the delivery address indicated by the Customer. The Products must be collected at the address and / or in the manner indicated by the carrier.
In case of non-collection within the deadline established by the carrier, the Products will be returned to Lapini S.r.l., which reserves the right to refund the price of the Products, leaving the shipping costs to be paid by the Customer.
In case of error concerning the Product, the Customer undertakes to return that Product or the Products concerned to Lapini S.r.l. within 7 (seven) days of receipt, with the packaging closed, in their original state and packaging and with the accompanying documents.
Once the Product has been received in appropriate form and manner, Lapini S.r.l. will return, at its own expense, the Product initially ordered.
All items in our e-shop are covered by a 24-month warranty for lack of conformity.
Before being shipped, all products undergo rigorous quality controls by Lapini S.r.l. However, in the event of problems, the customer benefits from the legal guarantee from the manufacturing company for a period of 24 months or 12 months if an invoice is requested. For the activation of the guarantee, the customer returns the product to Lapini S.r.l. at his own expense, attaching the original delivery document. The product will be replaced with an identical product and sent to the customer at the expense of Lapini S.r.l., except in the event of unavailability or discontinued production of the product itself. In the latter hypothesis, Lapini S.r.l. will refund the price of the product to the customer.
Right of withdrawal
The customer has the right to withdraw from the contract concluded with the vendor, without any penalty and without specifying the reason, within fourteen days (14), starting from the day of receipt of the products purchased on lapiniarezzo.it
To withdraw from the contract it is necessary to fill in the return form provided by the vendor.
Once the withdrawal from the contract has been exercised, the customer is obliged to return the products to the vendor by delivering them to the courier for shipment within 14 days from when the decision to withdraw from the contract was communicated to the vendor.
The return shipping costs are charged to the customer. For return shipments from countries outside the European Union, it is specified that any customs duties will be charged to the customer and will be deducted from the refund.
The right of withdrawal – in addition to compliance with the terms and methods described in this article 9, is intended to be correctly exercised if the following conditions are met:
- the appropriate form provided by the seller has been completed within 14 days of receiving the order;
- the products must not have been used or washed;
- the identification tag, which forms an integral part of the goods, where present, must still be attached to the products;
- the products must be returned in their original packaging, with the original labels, wrappers and other accessories that may be present and received in the package; the original product packaging must not be used as packaging boxes for return shipments.
- the returned products must be delivered to the shipper within fourteen (14) days starting from when the decision to withdraw from the contract was communicated to the seller;
- the products must not be damaged.
If the right of withdrawal is exercised according to the methods and terms indicated in this article 9, the vendor will refund any sums already collected for the purchase of the products according to the methods and terms provided.
The sums will be refunded to the customer in the shortest possible time and, in any case, within fourteen (14) days of receipt by the seller of the return of the goods and once the correct execution of the terms and conditions indicated above has been verified..
If the methods and terms for exercising the right of withdrawal, referred to in letters a), b), c), d), e) and f) of this article 9 are not respected, the customer will not be entitled to refund of sums already paid to the vendor. Within 14 days from the sending of the email with which the non-acceptance of the return will be communicated, the customer can choose to obtain, at his expense, the products in the state in which they were returned to the vendor, notifying the vendor himself, according to the methods which will be communicated to the customer. Otherwise, the seller can keep the products, in addition to the amounts already paid for their purchase.
The vendor reimburses using the same means of payment used to pay the price of the returned products, unless the customer has expressly agreed with the vendor the use of a different means of payment.
If there is no correspondence between the recipient of the products indicated in the order form and who made the payment of the sums due for their purchase, the refund of the sums, in case of exercise of the right of withdrawal, will be performed by the vendor, in in any case, towards the person who made the payment.
The payment of the amount is due at the time of the order.
The Customer undertakes to pay the agreed price for the Product ordered on the Site (price of the Products and the transport) as well as, if necessary, to pay the VAT or other import taxes of the Products in the countries where delivery will take place, directly to the courier or carrier.
The customer settles the order:
- by bank transfer to Lapini s.r.l .; In case of non-receipt by Lapini S.r.l. of the transfer within 14 days after order confirmation, Lapini S.r.l. reserves the right to cancel the order. The bank details are provided at the time of the order.
- through Paypal. The customer guarantees Lapini S.r.l. to have any necessary authorizations to use the Paypal payment method when ordering.

Non-payment – Retention of title
The ordered Products remain the property of Lapini S.r.l. until final payment in full of their price (pursuant to Art. 1523 and following of the CC.) Lapini S.r.l. reserves the right to claim the Products ordered in the event of non-payment.
In this case and at the request of Lapini S.r.l., the Customer undertakes to return any unpaid Product, at its own expense.
The computerized processing of data, including the management of the e-mail addresses of users of the site, is carried out in accordance with the provisions of the law.
The nominative data requested from the Customer are essential for the processing and forwarding of orders, the creation of invoices and any warranty contracts.
For this purpose, these data may be communicated to the contractual partners of Lapini S.r.l..
The customer can object to such communication and pursuant to the law makes use of the right of access, modification, rectification and cancellation of data concerning him by contacting Lapini S.r.l. To avoid any attempt at fraud, during the check-out phase, Lapini S.r.l. may ask for proof of your identity and / or your residence.
By concluding the order, the customer declares to have read the information on the processing of personal data available on the site.
Entirety of the contract
These general conditions of sale constitute the entirety of the obligations of the parties. No other general or particular condition communicated by the Customer can be inserted or excluded from these general conditions.
If one or more provisions of these general conditions are considered invalid or declared as such in application of a law, regulation or following a final decision taken by a competent jurisdiction, the other provisions will retain all their strength and value.
In the event of litigation and in the absence of an amicable agreement reached between the parties, without prejudice to the possible applicability of mandatory provisions of law placed to protect consumers (as defined pursuant to art.1 lett b) of Legislative Decree 22 May 1999 n. 185), any dispute related to these General Conditions will be devolved to the exclusive jurisdiction of the Court of Arezzo and interpreted in the light of Italian law.
Pursuant to and for the purposes of articles 1341 and 1342 of the civil code, the Customer declares to have carefully read and understood and to specifically accept all the clauses of the Lapini S.r.l. Terms and Conditions of Sale.
